The General Data Protection Regulations (GDPR) came into effect across the EU from 25th May 2018.
In accordance with these regulations, we have completed this Privacy Notice which explains how we use your personal information that we collect about you.
What information do we collect about you?
We collect information about you when you engage us for legal advice. This information will relate to your personal and possibly your financial circumstances. It may also include special categories of personal data such as data about your health, if this is necessary for the provision of your services.
Why do we need to collect and use your personal data?
In order to act for you on a correct legal basis, we need to use and process your data for the performance of our terms and conditions and the completion of the legal services we provide. The information that we collect about you is essential for us to be able to carry out these legal services that you require from us, effectively. Without collecting your personal data, we would also be unable to fulfil our legal and regulatory obligations.
How will we use information about you?
We will collect information about you in order to provide you with the legal services for which you engage us, in accordance with our terms and conditions.
Who might we share your information with?
If you instruct us and agree to our terms and conditions and in order to deliver our legal services to you effectively, we may send your details to third parties, such as those we engage with for professional compliance, ie barristers, doctors, accountants, cost drawers, other solicitors and other parties that may be connected in the legal services that we provide. Where such third parties are involved in the processing of your data, we will have a contract in place with them to ensure that the nature and purpose of the processing is clear and that they are subject to a duty of confidentiality in processing your data and that they will only act in accordance with your instructions.
Where it is necessary for your personal data to be forwarded to a third party, we will use appropriate security measures to protect your personal data intransit.
To fulfil our obligations in respect of prevention of money laundering and other financial crimes, we may send your details to a third party agency for identification purposes.
How long we hold your information?
During the course of our relationship with you, we will retain personal data which is necessary to provide services to you. We will take all reasonable steps to keep your personal data up to date throughout our relationship.
We are also subjected to regulatory requirements to retain your data for specific minimum periods and these are generally 6 years for all legal works, 12-15 years for property transactions, probate and some other areas.
These are minimum periods during which we will have a legal obligation to retain your records. We reserve the right to retain the data for longer where we believe it is in our legitimate interest to do so. We also reserve the right to not retain data for the minimum periods if we believe that there is no reason for us to retain the data.
You have a right to request deletion of your personal data. We will comply with this request, subject to the restrictions of our regulatory obligations and legitimate interests as noted above.
How can I access the information you hold about me?
You have the right to request a copy of the information that we hold about you. If you would like a copy of some or all of your personal information, please e-mail or write to us.
We have an obligation to ensure the personal information is accurate and up to date. Please ask us to correct or remove any information that you think is incorrect.
What can you do if you are unhappy with how your personal data is processed?
You have the right to lodge a complaint with the supervisory authority for data protection. In Northern Ireland this is the Information Commissioner’s Office, 3rd Floor, 14 Cromac Place, Belfast, BT7 2JB (Tel No: 02890 278757).
Changes to our privacy policy
We will keep our privacy policy under regular review and place any updates on our website (www.mkmsolicitors.com) and inform you of any changes when they occur. This privacy policy is dated 25th May 2018.
